Can you own a brand color? Cadbury to appeal in fight for purple
April 14th, 2008Purple, used in chocolate packaging by many companies but most notably Cadbury, seems to have retained its rights as a free and independent color.
This ABC news story reports that Cadbury will appeal the federal court ruling that it does not own the color purple.
The Cadbury claim revolves around leading the consumer to mistake one brand for another. Is rival chocolate maker, Darrell Lea, using purple packaging with the hope that consumers will mistake their product for Cadbury chocolate?
However the appeal turns out, we can rest assured that the Cadbury egg will not be affected, with its yellow packaging.
